Toasty AI provides AI-powered digital marketing services designed to help businesses improve their visibility and discoverability across traditional search engines and AI-powered platforms, including but not limited to Google, ChatGPT, Perplexity, and Gemini. The Service includes SEO and GEO optimization, AI visibility monitoring, content strategy, dynamic landing pages, paid media management, and related tools.

3. Account Registration and Security

To use certain features of the Service, you must create an account and provide accurate, complete, and current information. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

You must be at least 18 years old or the age of majority in your jurisdiction to create an account and use the Service.

6. Payment and Billing

Certain features of the Service may require a paid subscription. By subscribing to a paid plan, you agree to pay the applicable fees as described at the time of purchase. Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your selected plan).

All fees are non-refundable except as required by law or as explicitly stated in these Terms. We reserve the right to change our pricing at any time, with notice provided to existing subscribers before the next billing cycle.

If payment fails or your account becomes past due, we may suspend or terminate your access to paid features until payment is resolved.

7. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

You may terminate your account at any time by contacting us or through the account settings in the Service. Upon termination, your right to use the Service will immediately cease. Any data associated with your account may be deleted after a reasonable retention period.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Toasty AI does not warrant that the Service will function uninterrupted, secure, or error-free, that any defects will be corrected, or that the results obtained from using the Service will be accurate or reliable.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Toasty AI, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to, use of, or inability to access or use the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

Our total aggregate liability for all claims related to the Service shall not exceed the amount you paid to Toasty AI in the twelve (12) months preceding the event giving rise to the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Toasty AI and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of and access to the Service, your violation of these Terms, or your violation of any third-party rights.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located within the United States.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms.
